The practice of students is an obligatory component of the process of training specialists in higher educational institutions and is carried out at appropriately equipped practice bases of higher educational institutions, as well as at modern enterprises and organizations in various sectors of the economy, education, health, culture, trade and public administration. According to the curricula of higher educational institutions, the terms of professional practice make up 20-25% of the total study time. The organization of practical training of students is regulated by the Regulations on the practice of students of higher educational institutions.

Responsibility for the organization and implementation of the practical training of students is assigned directly to the heads of higher educational institutions. Educational and methodological guidance and the implementation of practice programs are provided by the relevant departments (subject or cycle commissions). The general organization of the practice of students and control over its implementation is carried out by the head of the practice. 1. The order is called "On Approval and Enactment from 01.06.2016 of the Procedure for Payment of Travel and Daily Allowances for Field Practices for St Petersburg University Students".

2. Daily allowance is a support measure aimed at paying for additional expenses associated with living outside the place of permanent residence, while such expenses may not be related to meals. Thus, the legislation does not consider daily allowances solely as compensation in full for the cost of food for a student during field practice.

According to paragraph 22 of the Regulations on the practice of students mastering the main professional educational programs of higher education, approved by Order of the Ministry of Education and Science of the Russian Federation dated November 27, 2015 No. 1383, when conducting on-site internships for students, the procedure for paying for travel to and from the place of internship, as well as additional expenses associated with living outside the place of permanent residence (per diem), for each day of practice, including being on the way to the place of practice and back, are established by the local regulatory act of the organization.

It should be noted that the norms of the daily allowance for field work practices are not established by the said Regulations. The issue of the payment of daily allowances for field training practices is not regulated by the Regulations.

Control over the production practice

Control over the implementation of the production practice is aimed at identifying and eliminating shortcomings and providing practical assistance to students in the implementation of the practice program.

Control by the BNTU should be carried out:

Practice leader;

Head of the department;

Representatives of the administration and intra-university inspection group.

The superintendent must take prompt measures to eliminate the identified deficiencies. The superintendent must immediately report serious shortcomings to the head of the university.

Summing up the work experience of students

At the end of the practice, students pass differentiated tests (defend reports) to the commission appointed by the head of the department. The results of industrial practice should be discussed at meetings of the department, faculty councils and BNTU, at scientific and methodological conferences.

Report Requirements

Each student at the end of the practice draws up a report that sets out information about the work performed. Collection, processing, systematization and preparation of materials for the report is carried out during the entire period of practice. At the end of the practice, the student is given 2-3 days to complete the report. The completed report is bound, signed by the student, signed by the head of practice from the enterprise and the university, and sealed with the seal of the enterprise.

The text must be typed on a computer on one side of white paper 210x297 format, left margin 30 mm, right margin 10 mm, upper margin 20 mm, lower margin 20 mm.

Section headings should be highlighted. Do not put a dot at the end of the title. Sections of the report are numbered with Arabic numerals. Pages are numbered in Arabic numerals and are end-to-end, the second page is the content.

The report contains the necessary illustrations: diagrams, drawings, sketches of photographs, etc. All illustrations are called drawings. Figures are numbered sequentially within the entire report in Arabic numerals. The figure number must consist of a section number and a figure serial number separated by a dot, for example: "fig.2.3" (second section, third figure). Figures should be placed immediately after the reference to them in the text of the report. Each figure has a caption.

Digital material is placed in the report in tables. Each table must have a heading. The table is placed after the first mention of it in the text. The tables are numbered within the report in Arabic numerals, the inscription is placed on the left above the table.

The list of references includes all sources used. Sources should be placed in the order in which references appear in the text of the report. Information about the book should include in the following sequence: the author's surname and initials, the title of the book, place of publication, publisher and year of publication, volume in pages. If there are three or more authors, it is allowed to indicate the surnames and initials of the first three of them and the word “and others.”

Information from the article, periodical should include: the surname and initials of the author, the title of the article, the name of the journal, the name of the series (if any), the year of issue, the volume, the number of the journal, the pages on which the article is placed.

Information about the invention should include: the author, the name of the invention, the filing date and application number, the edition in which the description of the invention was published. The information about the publication in which the description of the invention is published should indicate the name of the publication, the year of issue and the number, the country in which the author's invention or patent was issued.

Applications are made out as a continuation of the report on its subsequent pages. Each application starts on a new page, in the upper right corner they write the word "Application". The application must have a meaningful title.

1. General Provisions

Work practice is an integral part of the main educational program; it is carried out in accordance with the curricula and the schedule of the educational process in order to acquire practical work skills for students, to deepen and consolidate the knowledge, skills and abilities acquired in the process of theoretical training.

The purpose of the practice is to consolidate the knowledge gained by students in the learning process, based on studying the experience of various organizations in which they practice, as well as mastering functional skills.

In the process of practical training, students acquire organizational and professional experience.

Practice objectives:

· mastering the skills of law enforcement work;

expansion of professional horizons;

Acquisition of practical skills in the preparation and evaluation of official documentation, skills in working with incoming and outgoing documents;

education of performing discipline and the ability to independently solve emerging problems;

development of skills for independent analysis of the results of work;

getting an idea about the problems of professional activity in the host organization;

· development of business professional communication skills in compliance with the requirements of professional ethics;

· Improving the quality of professional training and education of specialists in the spirit of respect for the law.

The management of students' internship is carried out by the Department of Civil Law Disciplines and the head of the practice, appointed by order of the rector.

Before the start of the internship, the student must receive a trainee's ticket at the department and familiarize himself with the guidelines for organizing and passing the internship.

The main regulatory and methodological documents regulating the work of students in practice are: the program of practice; voucher for a trainee student; practice diary.

Distribution by places of practice and management of all practice are carried out in specific departments and services of the organization (institution).

During the internship, students are required to:

· to fulfill the tasks stipulated by the internship program in a qualitative and complete manner;

· comply with the internal regulations established in the organization or the schedule established by the head of practice;

Submit a report on the implementation of tasks to the head of the practice;

Collect and summarize the necessary material for the final qualifying work;

Timely submit a report on the results of the practice to the head of the department.

Heads of practice in the department of civil law disciplines timely distribute students to places of practice.

The obligations of an enterprise, organization, institution (practice base) are determined by the relevant agreement concluded with the Chuvash State University named after I.N. Ulyanov".

The goals of undergraduate practice are the collection of empirical material on the topic of the final qualification work, the testing of its theoretical part. Pre-diploma practice is aimed at ensuring the sequence of students mastering professional activities in accordance with the requirements for the level of graduate training. internship program reporting

In agreement with the supervisor, the student must choose the place of undergraduate practice. In this case, one should proceed from the specialization and the actual topic of the final qualifying work. Undergraduate practice is possible in several places.

Undergraduate practice in civil law specialization includes (depending on the topic of the thesis): collection, analysis of archival materials, scientific literature; search, collection and analysis of the necessary regulatory framework (work with the electronic legal database "Garant", "Consultant-plus", etc.); internship; other forms.

2. Organization of work practice

The organization of work practice at all stages is aimed at ensuring the continuity and consistency of mastering the skills of professional activity by students in accordance with the requirements for the level of training of a graduate in the specialty 030501 "Jurisprudence".

Places of practical training for students of civil law specialization, as a rule, are institutions that correspond to the profile of specialization. These include: courts of general jurisdiction; arbitration courts; legal departments of ministries, departments, organizations, enterprises, credit institutions, research organizations, etc.; specialized departments: patent office, consumer protection departments, etc.; legal (legal, contractual departments) of authorities and local self-government; notaries; advocacy, etc.

The student has the right, at his choice, to divide the practice in court into two parts and go through it, for example, two weeks in a court of general jurisdiction, and the second half - in an arbitration court (or other body), which will make it possible to understand the specifics of both civil and arbitration proceedings.

Regardless of the place of internship, the student must be familiar with the structure of the organization, its constituent documents, as well as with the contractual activities of the enterprise where he is doing internship: to get a general idea of ​​the contractual activity of a civil law nature, to get opportunities for practical development of issues related to with the conclusion of such contracts as, for example, a contract of sale (supply), a lease (sublease) contract, contracts for the provision of services; have an idea about the forms and methods of protection of violated civil rights, including the judicial form of protection.

The process of organizing industrial practice includes the following steps:

1. Preparatory.

2. Main.

3. Final.

The preparatory stage includes the following activities:

1. Holding an organizational meeting of students in order to familiarize them with: the goals and objectives of the upcoming practice; with the timing of its implementation; with the requirements that apply to practice as a type of educational activity; with a list of internship bases offered by the university.

2. Determining and assigning practice bases to students. At this stage, students submit an application either indicating the internship base with which the university has an agreement to organize students' internship, or indicating the place of internship of their choice. In the latter case, the student, in addition to the application, submits a letter of guarantee. At the same time, the department has the right to refuse to agree on the place of internship if it considers that the goals and objectives of the internship will not be achieved. Students who do not submit an application are provided with practice bases by the department.

3. Preparation of an order for an internship.

Subsequently, unauthorized change of the place of internship is not allowed.

The main stage includes the passage of internships by students within a specified period. The curriculum and the schedule of the educational process, developed on the basis of the SES VPO, provide for the following terms:

Passage of undergraduate practice, as a rule, includes two parts: the first - the student passes at his choice at the appropriate base of practice, the second (last week) - at the department or the Center for Information and Legal Counseling and Legal Education.

The introductory stage, during which the student receives a general idea of ​​the organization of the institution, the enterprise and its structure, the tasks solved by a particular unit where the student will have an internship. Before the start of the practice, all students must undergo a safety briefing at the place of practice, a general fire safety briefing, as well as a briefing on the internal regulations and certain features of its regime.

The main stage is devoted to the performance of work in accordance with the tasks set at a particular workplace, the acquisition of professional skills, as well as skills in processing research materials and compiling a report. Upon arrival at the place of internship, the student is recommended, together with the head of the internship from the institution (organization), to draw up a calendar plan for the internship. When drawing up a plan, you should be guided by this program. The plan should reflect the production and social work of the student, the collection and processing of materials necessary for writing a report on practice. The student performs all sections of the program throughout the entire period of practice.

The final stage. As a result of the practice, students submit the following documents to the department:

1) a report on the internship. The student must defend the prepared report on the practice at the department. Terms of defense - within the first 2 decades from the beginning of a new academic semester;

2) practice diary;

3) a properly completed voucher for a trainee student.

The student submits the documents listed above and defends the report to the head of practice from the department and the head of the department, within the time limits determined by the department.

The practice report after a successful defense is registered and stored at the department in accordance with the established deadline.

The evaluation criteria are:

* the level of students' theoretical understanding of the practical activities of the host organization (its goals, objectives, content, methods);

* the quality of the report on the results of practice;

* the degree and quality of professional skills acquired by the student;

* the level of professional orientation of the conclusions and recommendations made by the student during the internship.

According to the results of the defense, the student is given the mark "passed", "failed".

"Passed" - is given to a student who has completed the entire planned scope of work on time, fully and at a sufficient level, a completed report in accordance with all requirements.

"Not passed" - is given to a student who did not complete the practice program, did not prepare a report, made mistakes and violations of discipline during the practice.

The credit for practice is equal to the credit for theoretical training and is taken into account when summing up the overall progress of students.

The student is recommended, together with the head of the production practice from the enterprise, to draw up an indicative plan for the production practice according to the amount of time that the student should spend on each of its parts:

Acquaintance with the enterprise and drawing up a calendar plan for the entire period - 1-2 days;

Internship or work in a position determined by the head - 16 -17 days (for students of the third year); 23-24 days (for IV year students);

Work on the completion of the preparation of the report on production practice and its execution - 2 days.

The list of typical questions that are studied, worked out by students during the internship:

1. Acquaintance with the enterprise, its production, organizational and functional structure.

2. Familiarity with safety issues.

3. Isolation and analysis of all issues related to the disciplines of specialization (intellectual property law, corporate law, etc.).

4. Studying the experience of working in labor collectives in solving production and legal issues.

5. The study of information about the features of the interpretation of the law.

6. Study and analysis of the features of resolving various legal conflicts by competent officials.

7. Studying the features of the work of lawyers who do not have authority.

8. Study of specific production and other business documentation.

9. The study of new technological means in legal information systems used in the institution (organization).

10. Studying the technology of collecting, registering and processing legal information in a given organization (institution).

11. Identification of shortcomings in the work of this unit, their assessment.

12. Development of proposals for improving the existing work procedure, as well as for the introduction of new working methods. Acquisition of practical skills in specific jobs.

During the period of undergraduate practice, the student pays special attention to the collection, analysis of material for writing a final qualifying work.

4. Reporting on the completion of work experience

Based on the results of the internship, the student submits the following documents to the department:

1) student trainee voucher with the necessary marks and the seal of the enterprise - the practice base;

2) a report on the completion of industrial practice;

3) a diary about the passage of industrial practice.

Regardless of the basis of the internship, the student must read and reflect in the report:

* status (legal status) of an institution, organization, subordination links (system of interaction with other government bodies, business entities), a brief history of formation and development;

* office rules, principles of organization and main activities, powers of the host organization;

* organizational structure of the host organization; rights, duties and functions of the main structural units (management bodies) and officials;

* regulatory documents regulating the activities of the host organization (regulatory legal acts, local legal acts, including constituent documents, regulations on structural divisions, job descriptions, etc.);

* analysis of compliance with the performed service (statutory) functions and tasks.

By the end of the internship, the student draws up a detailed report on its passage. When writing a report, the student needs to systematize the work performed, give an analysis of the practice, taking into account its program. The report on the internship must be accompanied by documents compiled by the student himself during the internship. The report, together with its appendices, is bound or stitched. The student's referral for practice must be attached to the report.

It highlights the following points: the place and time of the internship; a description of the work performed in individual sections of the program, indicating the scope of this work; analysis of the most complex and interesting cases studied by the student in practice; indications of the difficulties encountered during the internship; presentation of controversial, complex legal issues arising in specific cases, and their solution; comments based on normative materials on certain documents with which the student got acquainted during practice.

In the report, the student must indicate how the practice went, what benefit it brought in the assimilation of theoretical material, and what assistance was provided to him by the leaders of the practice (teachers and practitioners).

The report should reflect the student's attitude to the materials studied, to the activities with which he got acquainted, the knowledge and skills that he acquired during the practice. The report should not be a repetition of the diary or a retelling of the practice program. It should also contain information about the materials necessary for writing coursework and final qualifying work, collected by the student during the internship (statistics, judicial and arbitration practice, analysis of certain categories of cases, etc.).

When writing a field trip report, it is recommended to follow the following plan:

Introduction (no more than 1 page);

1 section - organizational and legal characteristics of the enterprise (1-2 pages);

Section 2 - materials collected during the internship related to the chosen specialization (6-10 pages);

Conclusions and suggestions (2-3 pages);

The first section of the report sets out: location of the institution (organization); the size of the enterprise, its specialization, and in connection with this, a range of legal issues is listed; organizational structure and management structure.

The second section should contain answers to typical questions of industrial practice.

In the final part of the report, the student must briefly formulate the main conclusions, give specific proposals for improving the work of the institution (organization).

Report formatting requirements

The text is located on one side of a sheet of A4 white paper and must meet the following requirements:

Designed in Times New Roman font;

Letter height (point size) - 14, lettering - normal;

Line spacing - one and a half;

Formatting - in width.

Page settings: top margin - 20 mm, bottom - 20 mm, left - 30 mm, right - 10 mm.

The volume of work is within 10-15 pages. The pages of the report should be numbered with Arabic numerals, following the continuous numbering throughout the text of the work. The page number is placed in the middle of the top margin without a dot at the end. The title page is included in the overall page numbering of the work, but the page number is not affixed.

Diagrams, graphs, schemes, drawings, photographs, etc. are referred to as drawings, which are numbered sequentially through numbering under the figure; the title text is located at the bottom of the figure. The digital material placed in the report is recommended to be presented in the form of tables, which are also numbered consecutively in Arabic numerals. All tables must have a meaningful title. The heading is placed under the word "Table" above the corresponding table with digital material.

Annexes are drawn up as a continuation of the report on its subsequent pages, which are not numbered. Each application begins with a new page, in the upper right corner of which the word "Application" is indicated with consecutive numbering in Arabic numerals, for example, "Appendix 1", "Appendix 2", etc. Each application should have a thematic heading that reflects the essence of the document.

A sample design (content) of the title page is presented in Appendix. one.

The report on industrial practice is defended before the head of the practice and the head of the department.

The report is stitched and sealed with the seal of the enterprise - the base of practice, the signature of the head of practice from the enterprise, the signature of the student-trainee, the signatures of the head of practice from the department and the head of the department are affixed on the title page.

The practice diary is kept by the student and is a mandatory reporting document for the student (see Appendix 2). In the practice diary, it is necessary to write down daily brief information about the work done during the day. Records of work performed must be specific and signed by the head of practice (practitioner). With his permission, the student keeps the draft documents drawn up by him, notes in the diary all the questions that arise related to the resolution of specific cases. Keeping such records will make it easier for the student to write an internship report later.

The diary is sealed with the signatures of the head of practice from the enterprise and the student-trainee.

5. Work experience program

Practice in the courts of the system of federal courts of general jurisdiction and with justices of the peace

1. Familiarization:

* with the procedure for receiving citizens, organizing the work of the court to consider applications and complaints;

* with the organization of office work in the office of the court (accounting and registration of cases, materials, cards, etc.)

* with the powers of an assistant judge, justice of the peace, judges of federal courts, the chairman of the court and his deputy;

* with the organization of the work of the secretariat of the court, in general, the apparatus of the court, the justice of the peace;

2. Familiarization by direct presence at the relevant stages of the trial with the order of claim, absentee, writ, special proceedings; with the procedure for appeal proceedings on appealing decisions and rulings of justices of the peace.

Practice in arbitration courts

2. Familiarization:

* with lawsuit proceedings in the court of first instance, including direct presence at the preliminary court session, trial (5-10 cases);

* with the peculiarities of the consideration of cases arising from administrative and other public legal relations;

* all forms of judicial acts;

Practice in the Federal Registration Service (subdivisions)

1. Familiarization with the types of registries formed by the FRS.

2. In the field of registration of rights to real estate and transactions with it:

* with allocated registration districts;

* with the procedure for maintaining the Unified State Register of Rights to Real Estate;

* with the structure of the registry on electronic and paper media;

* with the procedure for maintaining a book of accounting documents;

* with forms for issuing information from the registry;

* with the size of the state fee for registration;

* with forms of certificates of state registration of rights and a special registration inscription on a document expressing the content of the transaction;

* with the requirements for documents submitted for state registration of rights;

* with types of documents containing a technical description of real estate objects.

* with the procedure for monitoring the customs value of goods;

* with measures for their enforcement.

2. For customs clearance and customs control:

* familiarization with the principles of customs control and its forms;

* participation in the verification of the customs declaration, other documents submitted to the customs authority, as well as the verification of goods in order to establish the conformity of the information specified in the customs declaration;

* study of lists of documents and information, requirements for information that is necessary for customs clearance in relation to specific customs procedures and customs regimes;

* studying the forms of customs documents, in particular, the procedure for processing a customs declaration.

3. Familiarization with information systems, information technologies and means of their support used by the customs authorities.

4. Familiarization with the procedure for conducting currency control of operations related to the movement of goods and vehicles across the customs border of the Russian Federation.

Registration of students for practice in an organization causes a number of difficulties, since this process is not directly regulated by labor legislation, there is no concept of an internship agreement between the employer and the trainee, and a clear algorithm of actions is not indicated anywhere.

In this article, we will consider the procedure for accepting a student for practice and touch on the main questions that an employer may have in this case.

Step 1. We conclude an agreement with an educational institution

First of all, it is worth noting that industrial practice relations arise between an educational institution (primary, secondary or higher vocational education) and an employer organization that provides places for students to practice, on the basis of an agreement concluded between them.

In pursuance of the conditions specified by the parties in such an agreement, the employer undertakes to create all the necessary conditions for students to undergo internship, as well as to provide them with appropriate places for this, and the educational institution, in turn, undertakes to guarantee that the trainee complies with the established labor discipline, as well as internal labor regulations approved by the employer, and other local regulations of the organization.

Step 2. We draw up an employment contract with an intern

The educational standard provides for two types of practice: educational (introductory) and production.

Since during the introductory practice the student does not perform a labor function, it is not necessary to conclude an employment contract with him, as well as to calculate wages. If the job offered to the student meets the requirements of the internship program and the qualification characteristics of the received specialty, and there is a vacancy at the enterprise, he is accepted into the staff of the organization with which the trainee has an employment relationship (clause 10 of the Regulations).

As a rule, a fixed-term employment contract is concluded with a student trainee, referring to the provisions established by Article 59 of the Labor Code 1 . The justification for concluding a fixed-term employment contract can be formulated something like this: “The employment contract is concluded for the duration of the internship” 2 . If a student has not worked anywhere before, he needs to have a work book and issue an insurance certificate of state pension insurance (part four of article 65 of the Labor Code of the Russian Federation).

From the moment the employment contract is concluded, the student is endowed with all the rights of an employee (he has the right to receive remuneration for work, is subject to state social insurance (clause 24 of the Regulations), he is paid temporary disability benefits, is granted annual paid leave, etc.).

In turn, a student doing an internship at an enterprise is obliged to follow the internal labor regulations approved by the employer, comply with labor protection requirements and comply with the provisions of the organization's local regulations 3 .

Step 3. Registration of an intern for work without enrolling him in the state

If there are no vacancies that meet the requirements of the internship program, and if the contract between the employer and the educational institution initially stipulates the conditions for the internship without the employment of students, an employment contract with the trainee is not concluded.

The enterprise issues an order or order on the enrollment of student interns for internships, which specifies the terms, time for the internship, and a responsible (mentor) for the internship is appointed (as a rule, this is the head or deputy head of the structural unit in which the internship takes place).

In this case, the trainee is not assigned a specific labor function, he is given the opportunity to get acquainted with the production, to perform tasks of reduced complexity. At the same time, the labor protection rules and internal regulations applicable to the employer apply to him.

Step 4. Registration of other documents

Students have the right to practice at their place of work, but it is important to take into account the position in which the trainee works and the specialty in which he is studying.

In this case, the student will need to submit to his educational institution a certificate issued by the employer stating that he is doing an internship at the place of work.

During the internship, the student is obliged to keep a diary and draw up a report at the end of it, which will reflect the results of his work 4 . Appropriate marks in them are made by specialists of the organization who supervise the work of trainees. Daily or at least once a week, the diary must be signed by the head of the practice. A practice diary certified by the head of the enterprise (signature and seal) is attached to the report.

In addition, at the end of the internship, the student is given a characteristic, which indicates the name of the organization where the student did the internship, the start and end dates of the internship, the type of work and their quality, information about the norms (time) of production, the degree of development of the technological process, recommendations for assigning qualification level, etc.
