Today, sick leave is issued on a secure paper form. From 07/01/2017, medical organizations can issue a sick leave in in electronic format, but this does not cancel the effect of paper disability certificates. New edition of the law of December 29, 2006 No. 255-FZ requires obtaining the written consent of the employee for this in order to issue an electronic sick leave, provided that the medical organization and the employer are participants in the system for the exchange of information for the formation of electronic sick leave (clause 5, article 13 of law No. 255 -FZ as amended on 05/01/2017).

From July 1, electronic sick leave will continue to be issued in accordance with the Procedure for issuing sick leave certificates (Order of the Ministry of Health and Social Development dated June 29, 2011 No. 624n). The employer should also independently enter data in the section "Filled in by the employer".

How will the electronic sick leave work?

If the insurer-employer has become a member of the electronic interaction system, then from 07/01/2017 he will have to work with electronic sick leave according to the following scheme:

  • The employee gives written consent to the issuance of sick leave in electronic form.
  • The medical organization enters the employee's sick leave data into the program.
  • Doctor assures electronic sheet incapacity for work with its electronic enhanced qualified signature, the medical organization also certifies the sheet with its signature.
  • A certified sick leave is sent by a medical institution to a single information system Social Security.
  • The employer electronically fills out his part of the disability certificate through his personal account.
  • Where there is a pilot project, the electronic hospital FSS pays directly, based on information entered into the system by the medical institution and the employer. In other regions, the employer receives information about the sick leave in the personal account of the insured, and according to the data received, calculates and pays benefits against insurance premiums on social insurance.

Electronic sick leave – benefit for all

The transition to the electronic form of sick leave should combine information on periods of disability for all employees into a single database. The benefits of innovation are obvious, here are some of its advantages:

  • saving not only money on the production of paper forms, but also the time spent on sending paper documents,
  • simplifying the procedure for filling out sick leave forms, reducing the number of errors when filling them out,
  • saving time for doctors and reducing the volume of paper workflow,
  • the ability to check whether the electronic sick leave is correctly drawn up, and, if necessary, request corrections without a second visit to the medical organization by the employee - just go to the "personal account" of the insured,
  • the employer gets the opportunity to track when an employee who did not go to work opened a sick leave and when he should go to work,
  • the employer is not required to send paper sick leave to the FSS,
  • electronic sick leave cannot be lost or destroyed,
  • such a document cannot be forged, which means that it does not have to be checked for authenticity,
  • It is easier for the FSS to control and analyze costs, as well as to eliminate cases of fraud.

At the same time, the employer is still free to choose the form of workflow, and may not switch to electronic sick leave. The paper form of the certificate of incapacity for work and after 07/01/2017 remains relevant along with the electronic one.

Recently, a friend of mine told me that he was denied the issuance of an electronic sick leave in a hospital. My friend regarded this act as a violation of the law, but you need to understand that at the moment not all hospitals are connected to the electronic database, so the refusal could be quite legal.

How can an employee view an email?

An electronic certificate can be viewed by both the employee and the employer. At the same time, it should be borne in mind that this document is confidential, therefore, some items of the electronic mail may not be visible to the employer (for example, usually the employer does not know the type of disease that his employee had).

In order for an employee to view an email, you need to use the following algorithm:

  • Register on the State Services Portal according to general algorithm(go through the initial authorization using your login and password, enter your data in special fields, go through authentication in any way convenient for you, and so on).
  • After that, open the official portal of the Social Insurance Fund and select "Personal Account" or follow the direct link http://cabinets.fss.ru
  • Select the "Insured person's account" item and enter the login and password that you use to enter the State Services portal.
  • If you entered your login and password correctly, then in this case a special window will open, which will list all the information about the services that the FSS provided to you (mostly these are various benefits - for disability, childbirth, unemployment, and so on). How can an employer view an email?

The electronic system also allows the employer to receive a compensation payment from the FSS for the employee, and the amount of financial assistance in the case of paper and electronic registration does not differ. In general, the procedure for filling out sheets and receiving compensation is as follows:

  • The employer enters into a special agreement with any regional office FSS to provide access to the database.
  • The employer registers in a special FSS program called EIIS "Social Insurance". Accounting and execution of all electronic and paper documents is carried out in this program.
  • The employer undertakes to train the accountant at his own expense so that he learns how to use the Social Insurance program. The law also allows you to hire an additional accountant who already owns the rules for using the program.
  • An accountant after completing the training must receive in some public institution(for example, in the MFC) a special electronic signature that will confirm the electronic certificates of the employee's treatment. All office expenses for registration must be borne by the employer.
  • The layout is ready. If any person has opened a certificate for undergoing treatment, then upon completion of the treatment, the employee is obliged to inform the accountant of a special code, which is the identification number of the certificate. After that, the accountant, using the Social Insurance program, finds the employee's sheet and fills out his part of the certificate. Then he calculates and pays compensation for treatment within no more than 10 days after receiving the certificate, and also submits information about the sick leave to the FSS - after a while the employer receives a monetary compensation for the treatment of a person from the FSS.

The features of filling out electronic sick leave in 2017 remained unchanged - the procedure for entering data is prescribed in Order No. 624n of 06/29/11. Draft law No. 27110-7 on electronic sick leave in 2017 was initiated by the Government of the Russian Federation and finally adopted in the third reading on April 14, 2017 in Resolution No. 1372-7 of the State Duma. Electronic sick leave in 2017 - regions

An experimental transition to electronic sick leave as part of a pilot project was launched back in 2014. Among the pioneers are the regions mentioned above, where new technologies were successfully tested. Over the past 3 years, the system has shown itself to be beneficial, and in 2017 it is planned to finally complete the implementation of the new Law No. 86-FZ through a nationwide transition to electronic registration of periods of illness.

Undoubtedly, ELN has many advantages. This is, first of all, the elimination of the likelihood of errors and inaccuracies when filling out, minimizing the cases of forging forms, reducing paperwork. Another important difference between electronic forms and conventional forms is the concealment of the diagnosis - the cause of the disease is not indicated openly in publicly available information. However, if the patient categorically does not want to draw up a hospital form in electronic format, no one has the right to force him to do so. Moreover, paper documents continue to be valid with full legal force and allow you to receive cash amounts of accrued benefits.

Electronic sick leave - how it works for the patient

To issue a certificate of incapacity for work, as before, the patient must first of all contact a doctor at an accredited medical organization that has the right to write out sick leave. The provision of qualified medical care is accompanied by the preparation of a sick leave form, which is formed in a special electronic system and, after being certified by an enhanced signature (EDS), is transferred to the general insurance database.

The patient no longer needs to run around the offices, wait in lines in order to collect various signatures of responsible persons. You also don’t have to worry about how the document is filled out - this is very important, because the presence of errors and inaccuracies leads to a refusal to assign the amount of benefits. All that is required is to obtain an electronic number, which, upon entering the service, is reported to the employer's administration. Further actions the enterprise takes over - checks the information, fills out the section for calculating benefits, transfers its part of the data to the FSS.

The transition to work on the ELP relieves employees of organizations from the need to notify the administration of companies about the fact of the disease. Functions of a personal account:

  • Tracking the movement of ELN, printing documents.
  • Entering data in the employer section for calculating benefits.
  • Export of information for the subsequent upload of a file in order to send it to the FSS.

Note! Enterprises have the right not to register on the FSS website and not to open personal accounts: today the legislation of the Russian Federation does not contain fines for such actions. The introduction of the law in mid-2017 has already saved about 12 million rubles due to the rejection of paper media, but over the period from 2017 to 2020, it will be saved in the budget from 42 million rubles, which is a big plus.

Of course, there are certain disadvantages that currently hinder the widespread implementation of the law. They are much less than the pros.

The cons include:

  • The technical unpreparedness of many medical institutions, especially rural ones, to switch to new system(a big minus is the lack of computers);
  • The unpreparedness of personnel, especially the older generation, for such radical changes in work;
  • It is necessary not only to establish a system in each medical institution, but also to ensure that it can work without failures;
  • Also, the disadvantages include the fact that many medical institutions today work on disparate systems from different software manufacturers that cannot be combined.

There is another disadvantage that needs to be mentioned. Not all employers, especially in the small business segment, have expressed interest in the new workflow. For these cases, the law stipulates a compromise solution: the patient can ask the medical institution to provide him with a sheet on paper.

Since July last year, sick leave can be issued both in paper and electronic form. But only if the patient agrees to this, and the doctor will have the technical ability to issue a digital document. After that, the employer connected to the Social Insurance system will only have to supplement it necessary information and pay the employee disability benefits.

The form of the disability certificate has remained unchanged since 2011. However, since last year, the method of issuing it has changed - they no longer issue it exclusively on paper form. From July 1, 2017, patients of hospitals and polyclinics began to receive electronic sick leave certificates. This innovation, as an experiment, was first mastered by individual regions, among which was Moscow. The pilot project was recognized as successful, and now electronic sick leave can be issued in dozens of regions. Only the insufficient material and technical base of medical institutions prevents the innovation from becoming ubiquitous.

By introducing an electronic sick leave, legislators pursued three main goals:

  • simplify the interaction between the medical organization, the employer, the sick employee and the FSS;
  • reduce the circulation of paper documents;
  • increase control over the authenticity of disability certificates, make their issuance transparent.

Despite the fact that the registration of "digital" sick leave is a legally permitted medical public service, a doctor will be able to write them out only if three mandatory conditions are met:

  1. The employee's employer registered on the official departmental website of the FSS and opened a personal account there.
  2. The medical institution has connected to a special information system for issuing electronic disability certificates.
  3. The patient issued and signed the consent to issue a digital document.

How it works

Electronic hospital document medical institution opens as follows:

  1. The employee, having visited the doctor's office, informs him of the desire to take an electronic certificate of incapacity for work (briefly - ELN). In doing so, he:
    • informs the doctor about the participation of the employer-insured in the information exchange of information necessary for the formation of "digital" sick leave;
    • fills in and signs an application for consent to issue a document in electronic form;
    • presents SNILS or reports its number.
  2. The doctor sends an online request to the information system ("Social Insurance") to assign a number to the document. Having received it, the health worker, using specially developed software, fills in the ELS. The sick leave number is reported to the insured person (patient).
  3. Having completed the steps to issue an electronic sick leave, the doctor certifies it with a digital personal signature.
  4. The medical institution certifies the generated document over the network with its own signature and sends it to Social Insurance.

If the employee’s illness has dragged on and an extension of the disability certificate is needed, it, as necessary, is supplemented with new entries. After the closure of the sick leave, an appropriate entry is made in the ELN, the document is certified by the digital signature of the doctor and the clinic, and then sent to Social Insurance.

This service is provided to patients of medical organizations free of charge. All information is transmitted through special secure channels, which are considered inaccessible to someone else's eyes or data correction by an unauthorized person.

Actions of personnel officers upon receipt of ELN

Having learned the number of the electronic certificate of incapacity for work, the employee informs his employer. According to it and the SNILS number of the employee himself, personnel officers or accountants electronically request sick leave data from the FSS. In order for it to be displayed on the screen, you must click on the "GET LN" button.

Important note! The employer gets access to the employee's digital sick leave only after the document is closed by a medical organization. He will not be able to view the current ELN.

When the employer's representative receives electronic document, he enters the missing information into it, and corrects if something is filled in incorrectly (he sees a message about this inside the system). For him, the program has an eloquent tab: "Filled in by the employer." There he, in particular, makes:

  • the name of the company where the insured person works;
  • a part-time worker or the main employee is the owner of a citizen who has been issued a sick leave;
  • his TIN;
  • surnames with initials - the head of the company and the chief accountant;
  • the average salary of the insured employee and his length of service;
  • period of disability;
  • date when he started work, and other information.

Based on the data entered, the disability benefit due to the employee is automatically calculated by the program. The employee receives a sick leave payment, and data on its size are reported to the insurer - to the FSS.

Advantages and disadvantages of electronic registration

On the one hand, reducing paperwork and high degree reliability of ELN are its undeniable advantages over paper counterparts. However, the disadvantages of this method as long as it's enough.

Electronic LNs are much more difficult to fake - this requires high technical literacy, special knowledge and hard work. Possible virus attacks, after which the data stored in the system can either be completely destroyed or changed to incorrect ones.
Fewer unintentional errors are allowed in benefit calculations and are easier to check and correct. Connection to unified system"Sotsstrakh" will require additional financial investments (acquisition of computers, software, training events, etc.).
There is no need for numerous checks by the insurer. The doctor's inept handling of the program, freezing and other problems with the equipment may not save time, but, on the contrary, make visits to specialists even longer.

Will the paper version remain?

If you do not look into the very distant future, it is safe to assume that the usual paper sick leave will serve the Russians for quite a long time. Their forcible non-alternative introduction can hurt the pocket of small businesses, when, for example, a company consisting of 3-5 people will be forced to buy expensive equipment and incur other expenses only for the whim of the state.

Recall that under the current legislation, organizations employing less than 25 people are not required to keep records in electronic form at all. And this rule also applies to sick leave reports.

Low equipment medical institutions in many regions of Russia, the transition to exclusively ELN will also slow down. In the foreseeable decades, doctors are likely to retain the skill of issuing disability certificates on paper forms.
